Terms of use

These General Terms and Conditions govern the relationship and agreements between Pearlfectly You (hereinafter "Pearlfectly You," "we," or "us") and any individual or entity (hereinafter "the Customer" or "you") engaging with our boutique or placing an order through our digital platform.

1. Scope of Agreement

  • 1.1 Applicability: These terms apply to all offers, digital transactions, and agreements established via Pearlfectly You, registered with the Dutch Chamber of Commerce (KvK) under number 89469305.
  • 1.2 Acceptance: By finalizing a purchase or creating an account, you formally acknowledge and accept these Terms and Conditions in their entirety.

2. The Ordering Process

  • 2.1 Availability: All jewellery pieces are subject to material availability. In the rare event that a component for your selected piece is unavailable, we will notify you immediately.
  • 2.2 Order Acceptance: A contract is only established once Pearlfectly You sends a formal order confirmation to your provided email address. We reserve the right to decline or cancel an order (for example, in cases of suspected fraud or incorrect pricing) at our sole discretion.
  • 2.3 Customer Responsibility: You are responsible for ensuring that all contact and delivery information provided during checkout is accurate and complete.

3. Investment & Payment

  • 3.1 Pricing: All prices displayed are in Euros (€) and include the applicable Value Added Tax (VAT), unless explicitly stated otherwise.
  • 3.2 Adjustments: We reserve the right to adjust our pricing to reflect changes in material costs or market conditions. However, the price confirmed at the time of your order is the final price you will pay.
  • 3.3 Secure Payment: Transactions must be completed using the secure payment methods integrated into our Shopify checkout.

4. Shipping & Handcrafted Delivery

  • 4.1 Processing Time: As many of our pieces involve handcrafted elements, we strive to ship orders within the estimated timeframe indicated on the product page.
  • 4.2 Delivery Address: Delivery will be made to the specific address provided by you. Pearlfectly You is not responsible for unsuccessful deliveries resulting from incorrect address data.
  • 4.3 Delays & Force Majeure: While we partner with reliable carriers, we are not liable for transit delays caused by unforeseen circumstances, strikes, or "force majeure" events beyond our reasonable control.

5. Returns & Exchanges

  • 5.1 Right of Withdrawal: In accordance with EU consumer rights, you have the right to return your purchase within 14 days of receipt, provided the item is in its original, unworn condition.
  • 5.2 Bespoke & Custom Pieces: Please note that jewellery customized specifically for you (e.g., custom sizing, engravings, or unique pearl selections) is exempt from the standard right of return.
  • 5.3 Return Logistics: Unless otherwise agreed in writing, the costs and risks associated with the return shipment are the responsibility of the Customer.

6. Protection of Artistry (Intellectual Property)

  • 6.1 Ownership: Pearlfectly You retains full ownership of all intellectual property, including unique jewellery designs, brand photography, logos, and website copy.
  • 6.2 Prohibited Use: The reproduction, distribution, or commercial use of any material from our Atelier without our prior written authorization is strictly prohibited.

7. Warranty & Liability

  • 7.1 Product Care: Jewellery is delicate. Pearlfectly You is not liable for damage resulting from improper care, accidental breakage, or normal wear and tear over time.
  • 7.2 Limitation: Our liability for any claim related to a purchase is strictly limited to the total purchase price of the item in question. We are not liable for indirect or consequential losses.

8. Support & Solutions

  • 8.1 Customer Care: We are committed to your satisfaction. For any inquiries, styling questions, or complaints, please reach out via our official contact channels.
  • 8.2 Resolution: We aim to respond to all inquiries within a reasonable timeframe to resolve any issues with grace and efficiency.

9. Governing Law

  • 9.1 Jurisdiction: All agreements are governed exclusively by the laws of the Netherlands.
  • 9.2 Disputes: Any disputes that cannot be resolved through mutual consultation will be submitted to the competent courts of the Netherlands.

10. Amendments & Validity

  • 10.1 Severability: If any part of these terms is found to be legally unenforceable, the remainder of the terms shall remain in full effect.
  • 10.2 Updates: We may update these terms to reflect changes in our boutique’s operations. New orders placed after an update will be governed by the revised terms.
